Patrick <br /> 526 Tupelo Drive <br /> Bossier City, Louisiana 71111 <br /> Re: Docket No. 2025-326 <br /> Advisory Opinion <br /> Dear Mr. Patrick: <br /> The Louisiana Board of Ethics (`Board"), at its meeting on July 3, 2025, considered your request <br /> for an advisory opinion as to whether the Code of Governmental Ethics ("Code") permits your <br /> employer to bid on projects with the Office of Facility Planning and Control while your step-father <br /> is employed by the Off'ice of Facility Planning and Control. <br /> FACTS PROVIDED <br /> Your step-father is employed as a Project Manager with the Office of Facility Planning and <br /> Control. <br /> You are a Professional Engineer and a Professional Land Surveyor. You work as a Senior Project <br /> Manager for a private company in Shreveport, Louisiana.Your einployer would like to submit bids <br /> for consideration on projects with the Office of Facility Planning and Control in which you could <br /> potentially be involved. <br /> LAW <br /> La. R.S. 42:1113A(1)(a) provides that no public servant, excluding any legislator and any <br /> appointed member of any board of commission and any member of a governing authority of a <br /> parish with a population of ten thousand or less, or meinber of such a public servant's immediate <br /> family, or legal entity in which he has a controlling interest shall bid on or enter into any contract, <br /> subcontract, or other transaction that is under the supervision or jurisdiction of the agency of such <br /> public servant. <br /> La. R.S. 42:1102(13) defines "iminediate family" as it relates to a public servant to mean his <br /> children, the spouses of his children, his brothers and their spouses, his sisters and their spouses, <br /> his parents, his spouse, and the parents of his spouse. <br /> ANALYSIS AND CONCLUSION <br /> Generally, La.
