Pursuant to <br /> Re: Docket No. 2025-379 LSA-R.S. 42:1141.4K <br /> Advisory Opinion <br /> Dear Ms. Gaubert: <br /> The Louisiana Board of Ethics, at its meeting on August 8, 2025, considered your request for an <br /> advisory opinion regarding whether the Code of Governmental Ethics ("Code")prohibits you, the <br /> Public Safety Grants and Administration Director for Jefferson Parish Government, from seeking <br /> secondary outside employment writing grants. <br /> FACTS PROVIDED <br /> In your position as Director,you are responsible for managing the FEMA Public Assistance grants <br /> program as well as pre-award grant assistance for various parish departments.You would like to <br /> accept some part-time,project-based consulting work in the public/private grant and/or emergency <br /> grant management grant consulting industry on out-of-state projects only. They would not have <br /> any relation to any Louisiana grant applications which your department is working on. <br /> As the Director,you provide,but are not limited to providing,the following services:you supervise <br /> and oversee all project management; you provide oversight for the FEMA Public Assistant Grants <br /> Program;and,you assist the Parish in researching and applying for grant funding for infrastructure, <br /> preparedness, and recovery programs. However, you stated that you do not provide consulting <br /> services on private grants in your public position. <br /> LAW <br /> La. R.S. 42:1111C(1)(a) No public servant shall receive any thing of economic value for any <br /> service, the subject matter of which is devoted substantially to the responsibilities, programs, or <br /> operations of the agency of the public servant and in which the public servant has participated. <br /> La.R.S. 42:1102(2)(a)(vi)defines"agency"to mean,for public servants of political subdivisions, <br /> it shall mean the agency in which the public servant serves, except that for members of any <br /> governing authority and for the elected or appointed chief executive of a governmental entity, it <br /> shall mean the governmental entity. <br /> La.
