Your public duties are to audit <br /> output volume, and you do not handle any royalties, or financial data. You stated that you have <br /> outside employment with Theophilus Oil, Gas& Land Service, LLC. Your duties include courrier <br /> and GIS analyst services,neither of them are part of your public job duties as a Mineral Production <br /> Manager. You want to know if you can do research for Theophilus Oil, Gas & Land Service in <br /> your free time, including researching royalty payments on www.sonris.com. This information is <br /> available to the public on DENR's website. You will work for them during your normal work <br /> hours. Further, you provided that your section,the Mineral Production Section, does not maintain <br /> the database. <br /> LAw <br /> La. R.S. 42:1111C(1)(a)prohibits a public servant from receiving any thing of economic value <br /> for any service, the subject matter of which is devoted substantially to the responsibilities, <br /> programs, or operations of the agency of the public servant and in which the public servant has <br /> participated or(b) Draws substantially upon official data or ideas which have not become part of <br /> the body of public information.. <br /> La. R.S. 42:1102(2)(a)(i) defines "agency" to mean a department, office, division, agency, <br /> commission, board, committee, or other organizational unit of a governmental entity.
