Box 1905 <br /> Houma, IA 70361 <br /> RE: Ethics Docket No. 2011-1619 <br /> Dear Ms. Alcock, <br /> The Louisiana Board of Ethics at its December 16, 2011 meeting, considered your request for an <br /> advisory opinion regarding whether the mother of the Senior Technician for the Terrebonne Parish <br /> Housing Rehabilitation Program may apply to receive assistance from the program. You stated that. <br /> David Armstrong is a Terrebonne Parish Senior Housing Rehabilitation Technician for the Housing <br /> Rehabilitation Program. The program operates in the Community Development division. Under the <br /> Rehabilitation Program,low to moderate income families receive assistance with bringingtheir existing - <br /> homes up to parish codes.The applicants for the program must meet low-income guidelines to qualify <br /> for aid.As a technician for the Housing Rehabilitation Program,Mr.Armstrong has no administrative <br /> control over the program. <br /> The Board concluded and instructed me to inform you that the Louisiana Code of Governmental <br /> Ethics will prohibit. Mr. Armstrong's mother from applying for assistance from the Housing <br /> Rehabilitation Program. Section 1113 of the Code prohibits the immediate family of a public servant. <br /> from bidding on, contracting, subcontracting or entering into transactions that are under the <br /> supervision of the agency of the public servant.As the senior technician for the Housing Rehabilitation <br /> Program, Mr. Armstrong's agency is the Program and as such, his mother, as an immediate family <br /> member, would be prohibited from entering into transactions with the Housing Rehabilitation <br /> Program. <br /> This advisory opinion is based solely on the facts as set forth herein.Changes to the facts as presented <br /> may result in a different application of the provisions of the Code of Ethics. The Board issues no <br /> opinion as to past conduct or laws other than the Code of Governmental Ethics.
