Box 238 <br /> Franklin, Louisiana 70538 <br /> Re: Ethics Board Docket No. 2010-990 <br /> Dear Mr. Duplantis: <br /> The Louisiana Board of Ethics, at its November 18, 2010 meeting, considered your request for an <br /> advisory opinion regarding whether a former member of the Board of Commissioners of the West <br /> St. Mary Parish Port Harbor and Terminal District(District)may donate his services to the agency <br /> before the expiration of two years from the date of his termination, to fulfill the services provided <br /> by the outgoing Executive Director of the District.The District is a political subdivision of Louisiana <br /> that is governed by a nine-member board. Its daily operations are administered through an Executive <br /> Director who is selected by a majority vote of the Board of Commissioners. You indicated that the <br /> former Board Member will not be compensated for any services provided, rather he will donate his <br /> time and services voluntarily. <br /> The Board concluded, and instructed me to inform you that the Code of Governmental Ethics will <br /> not prohibit the former board member from providing uncompensated, volunteer services to the <br /> District in the form of the duties formerly provided by the Executive Director,as long as the former <br /> board member is not appointed to any position by his former board. Section 1121A(2)states that no <br /> former member of a board or commission shall,for a period of two years,following the termination <br /> of his public service on such board or commission, contract with, be employed in any capacity by, <br /> or be appointed to any position by that board or commission; however. Section 1123(30) allows a <br /> public servant to donate services to his agency. <br /> The Board issues no opinion as to laws other than the Code of Governmental Ethics. This advisory <br /> opinion is based solely on the facts as set forth herein. Changes to the facts as presented may result <br /> in a different application of the provisions of the Code of Ethics.
