Wallace <br /> 12223 Beacon Tree Dr. <br /> Baton Rouge, La. 70810 <br /> Re: Board Docket N .2012-1468 <br /> Dear Mr. Wallace: <br /> The Louisiana Board of Ethics, t its October 19th, 2012 meeting, considered your request for an <br /> advisory opinion regarding the a plication of post employment restrictions to you when you retire <br /> from the Louisiana Departmen of Transportation and Development where you are currently <br /> employed as a Right of Way Re iew Appraiser. Specifically, you asked whether the Ethics Code <br /> permitted you to be added to the DOTD Real Estate Section Appraisal Panel to perform contract <br /> work as a Real Estate Appraiser i mediately upon your retirement. You indicated that the contract <br /> real estate appraisal work you ay receive would require you to provide the Department with <br /> different services than the real state appraisal review which you have been providing to the <br /> Department for the last 17 years. You have stated that you are not an agency head and as a contract <br /> appraiser you would not work o any files which you have reviewed. You stated that all projects <br /> would be new projects. <br /> The Board concluded and ins o cted me to inform you that you would not be prohibited from <br /> performing contract work as a R:al Estate Appraiser, under the Ethics Code as it stands now. The <br /> Code of Governmental Ethics seg. ion 1121.B(1)prohibits a public servant for a period of two years <br /> following the termination of his .ublic employment from rendering any service which such former <br /> public employee rendered to the •gency during the term of his public employment on a contractual <br /> basis on behalf of the agency th which he was formerly employed. Because you will not be <br /> contracting with an person to provide the same services you provided to your agency during your <br /> employment, nor would you be . sisitng a person, for compensation, in a transaction in which you <br /> participated, no violation of the I ode is presented. <br /> This advisory opinion is based so ely on the facts as set forth herein. Changes to the facts presented <br /> may result in a different applicaf•n of the provisions of the Code of Ethics.
