You stated that <br /> you are the owner of a building construction firm and have been asked by the City of Jeanerette to <br /> do renovations to the Jeanerette Museum. The Jeanerette Museum is owned by the City of <br /> Jeanerette and operated by the Parish's Recreation and Playground District Board. The Jeanerette <br /> Museum's renovations are to be paid for by a grant received by the City of Jeanerette. Your firm <br /> would be paid directly by the City of Jeanerette. <br /> The Board concluded and instructed me to inform you that the Code of Governmental Ethics will <br /> not prohibit you from entering into a contract with the City of Jeanerette to provide renovations to <br /> the Jeanerette Museum. Section 1113A of the Code prohibits a public servant or a legal entity in <br /> which the public servant has a substantial economic interest from entering into any contract, <br /> subcontract,or any transaction which is under the supervision of the agency of the public servant. <br /> It does not appear that you or your firm will be entering into a transaction that is under the <br /> supervision of your agency,the Iberia Parish Council. The contract will be between your firm and <br /> the City of Jeanerette. The City of Jeanerette is not under the supervision of the Iberia Parish <br /> Council. As such, there is no violation of the Code for your firm to enter into a contract with the <br /> City of Jeanerette to perform services to the Jeanerette Museum. <br /> This advisory opinion is based solely on the facts as set forth herein. Changes to the facts as <br /> presented may result in a different application of the provisions of the Code of Ethics. The Board <br /> issues no opinion as to past conduct or laws other than the Code of Governmental Ethics.
