La. R.S. 42:1102(3) "Agency head" means the chief executive or administrative officer of an <br /> agency or any member of a board or commission who exercises supervision over the agency. <br /> ANALYSIS <br /> As Assistant Secretary of Operations, you were an agency head of the Office of Operations, <br /> according to La. R.S. 42:1102(3). The Assistant Secretary is an "agency head" since the Assistant <br /> Secretary is an "administrative officer of an agency who exercises supervision over the agency". <br /> Therefore, pursuant to La. R.S. 42:1121A(1), you are prohibited, for a period of two years <br /> following your retirement date, from assisting another person, for compensation, in a transaction, <br /> or in an appearance with a transaction, involving the Office of Operations or fi-om rendering any <br /> service on a contractual basis to or for the Office of Operations. <br /> Furthermore, pursuant to La. R.S. 42:1121B, you are prohibited, for a period of two years <br /> following your retirement date, from assisting another person, for compensation, in a transaction, <br /> or in an appearance with a transaction, in which you participated during your public employment, <br /> or from rendering any service to the Office of Operations which you rendered during the term of <br /> your public employment. <br /> CONCLUSION <br /> The Board concluded, and instructed me to inform you, that the Code of Governmental Ethics <br /> prohibits you, for a period of two years following your retirement date, from assisting another <br /> person, for compensation, in a transaction, or in an appearance with a transaction, involving the <br /> Office of Operations or from rendering any service on a contractual basis to or for the Office of <br /> Operations. Furthermore, you are prohibited, for a period of two years following your retirement <br /> date, from assisting another person, for compensation, in a transaction, or in an appearance with a <br /> transaction, in which you participated during your public employment, or from rendering any <br /> service to the Office of Operations which you rendered during the term of your public employment. <br /> This advisory opinion is based solely on the facts as set forth herein. Changes to the facts as <br /> presented may result in a different application of the provisions of the Code of Governmental <br /> Ethics. The Board issues no opinion as to past conduct and or to laws other than the Code of <br /> Governmental Ethics, the Campaign Finance Disclosure Act, the Lobbyist Disclosure Acts, and <br /> the conflict of interest provisions contained in the Louisiana Gaming Control Law. <br /> Page 3 of 4(BD 2022-810) <br />
