Box 176 <br /> Springhill, LA 71075 <br /> Re: Docket No.2022-810 <br /> Advisory Opinion <br /> Dear Ms. Duggan: <br /> The Louisiana Board of Ethics, at its meeting on December 2, 2022, considered your request for <br /> an advisory opinion regarding whether a member of the Springhill City Council can be appointed <br /> to the North Webster Industrial Board after retirement as City Councilman in January 2023. <br /> FACTS PROVIDED <br /> The North Webster Parish Industrial District is a political subdivision of the State of Louisiana and <br /> its territorial limits and jurisdiction extend throughout Ward 2, Webster Parish, Louisiana as <br /> stipulated in La. R.S. 39:551.5. <br /> The governing authority of the North Webster Parish Industrial District is a Board of <br /> Commissioners consisting of seven members, two of whom shall be appointed by the governing <br /> authority of the City of Springhill. One of the current Springhill City Council members will be <br /> retiring as City Alderman on December 31,2022.The governing authority of the City of Springhill <br /> would like to appoint the soon to be retired Alderman to the North Webster Industrial Board to <br /> start after retirement in January 2023. The Mayor of Springhill recommends someone to serve on <br /> the North Webster Industrial Board and the Springhill City Council approves the recommendation. <br /> The board members of North Webster Industrial Board are not compensated for their services. <br /> LAW <br /> La.R.S.42:1121A(2)provides that no former member of a board or commission shall,for a period <br /> of two years following the termination of his public service on such board or commission, contract <br /> with,be employed in any capacity by,or be appointed to any position by that board or commission. <br /> ANALYSIS <br /> Parish or municipal councils have been interpreted to be included in the meaning of"boards and <br /> commissions" for purposes of La.
