FAX: (225)381-7271 <br /> 1-800-842-6630 <br /> www.ethics.1a.gov <br /> December 7, 2022 <br /> Kia Price <br /> 1640 Royal Troon Street <br /> Zachary, Louisiana 70791 <br /> Re: Docket No. 2022-338 <br /> Advisory Opinion <br /> Dear Ms. Price: <br /> The Louisiana Board of Ethics, at its meeting on December 2, 2022, considered your request for <br /> an advisory opinion as to whether the Code of Governmental Ethics ("Code")would prohibit you, <br /> as an employee of the Louisiana Department of Health, from operating a non-profit entity which <br /> works with the homeless population. <br /> FACTS PROVIDED <br /> You are an employee at the Louisiana Department of Health ("LDH"). In your role at LDH, you <br /> work under Assistant Secretary Melinda Richard in the Office of Aging and Adult Services <br /> ("OAAS"), and you manage staff, determine eligibility and make referrals with respect to the <br /> Permanent Supportive Housing ("PSH") program for housing vouchers for continuum of care. <br /> You have formed a non-profit corporation, The Forgotten War Incorporated ("The Forgotten <br /> War") to work with the homeless population. The Forgotten War plans to own and manage <br /> properties that would be occupied by residents who receive housing vouchers and subsidies from <br /> programs other than PSH and not affiliated with LDH or OAAS ("Unaffiliated Vouchers"), <br /> including, for example, Section 8 and Emergency Housing Vouchers. Unaffiliated Vouchers are <br /> overseen and regulated by agencies other than OAAS and LDH, including the Louisiana Housing <br /> Corporation. Any person receiving an Unaffiliated Voucher cannot be considered for assistance in <br /> the PSH program.Further,The Forgotten War would not work with any person in the PSH program <br /> or otherwise receiving assistance from OAAS. <br /> The Forgotten War is formed on a non-stock basis. You serve as President of The Forgotten War, <br /> you have managerial control over The Forgotten War, and you plan to be compensated for <br /> managing The Forgotten War. <br /> You would like to know whether either you or The Forgotten War may contract with recipients of <br /> Unaffiliated Vouchers. You also wish to know if The Forgotten War may contract with agencies <br /> other than OAAS and LDH with respect to Unaffiliated Vouchers.
