Box 2768 <br /> Houma, Louisiana 70361 <br /> Re: Docket No.2023-407 <br /> Advisory Opinion <br /> Dear Mr. Pulaski: <br /> The Louisiana Board of Ethics, at its meeting on July 7, 2023, considered your request for an <br /> advisory opinion on behalf of Terrebonne Parish Consolidated Government as to whether the Code <br /> of Governmental Ethics ("Code") prohibits your step-sister from responding to a Request for <br /> Proposal issued by the Terrebonne Planning &Zoning Department. <br /> FACTSPROVIDED <br /> You are the Director of the Planning & Zoning Department for Terrebonne Parish Government. <br /> The Planning&Zoning Department needs house painting services on the Folklife Cultural Center. <br /> A Request for Proposal will be issued for bids for the painting services.You ask whether your step- <br /> sister is prohibited from submitting a bid and being selected as the contractor. <br /> LAw <br /> La. R.S. 42:1113(A)(1)(a):No public servant,excluding any legislator and any appointed member <br /> of any board or commission and any member of a governing authority of a parish with a population <br /> of ten thousand or less, or member of such a public servants immediate family, or legal entity in <br /> which he has a controlling interest shall bid on or enter into any contract, subcontract, or other <br /> transaction that is under the supervision or jurisdiction of the agency of such public servant. <br /> La. R.S. 42:1102(13) defines "immediate family member" as the term relates to a public servant <br /> to mean his children, the spouses of his children, his brothers and their spouses, his sisters and <br /> their spouses, his parents,his spouse, and the parents of his spouse. <br /> ANALYSIS&CONCLUSION <br /> Generally, your immediate family members are prohibited by La. R.S. 42:1113(A) from bidding <br /> on or entering into a transaction that is under the supervision or jurisdiction of the Terrebonne <br /> Planning& Zoning Department.
