PROVISIONS OF LAW: <br /> 10. <br /> La.R.S.42:1111A(1)(a): <br /> No public servant shall receive any thing of economic value, other than <br /> compensation and benefits from the governmental entity to which he is duly <br /> entitled, for the performance of the duties and responsibilities of his office or <br /> position. <br /> 11. <br /> La.R.S. 42:1112A: <br /> No public servant...shall participate in a transaction in which he has a personal <br /> substantial economic interest of which he may be reasonably expected to know <br /> involving the governmental entity. <br /> 12. <br /> The following terms are defined in Section 1102 of the Code and are relevant when <br /> analyzing the above Sections: <br /> 3 + + <br /> (2)(a)"Agency" means a department, office, division, agency, commission,board, <br /> committee, or other organizational unit of a governmental entity. For purposes of <br /> this Chapter, "agency of the public servant' and "his agency" when used in <br /> reference to the agency of a public servant shall mean: <br /> (vi)For public servants of political subdivisions, it shall mean the agency in which <br /> the public servant serves, except that for members of any governing authority and <br /> for the elected or appointed chief executive of a governmental entity,it shall mean <br /> the governmental entity. Public servants of political subdivisions shall include, but <br /> shall not be limited to, elected officials and public employees of municipalities, <br /> parishes, and other political subdivisions; sheriffs and their employees; district <br /> attorneys and their employees; coroners and their employees; and clerks of court <br /> and their employees. <br /> (13) "Governmental entity" means the state or any political subdivision which <br /> employees the public employee. <br /> (2 1)"Substantial economic interest"means an economic interest which is of greater <br /> benefit to the public servant than to a general class or group of persons. <br />
