Ethics Board Docket No. 2022434 <br /> Page 4 of 13 <br /> 8. <br /> If called to testify, each of Scott Hearne, Frederick Williams and Michael Roberts would <br /> state that they did not intend to violate the Ethics Code, and believed that they were following <br /> standing practices of LSBH1 members. <br /> IV. <br /> PROVISIONS OF LAW: <br /> 1. <br /> Section 1111C(2)(d) of the Ethics Code provides that no public servant and no legal <br /> entity in which the public servant exercises control or owns an interest in excess of twenty-five <br /> percent, shall receive any thing of economic value for or in consideration of services rendered, or <br /> to be rendered, to or for any person during his public service unless such services are neither <br /> performed for nor compensated by any person or from any officer, director, agent, or employee <br /> of such person, if such public servant knows or reasonably should know that such person has <br /> conducts operations or activities which are regulated by the public employee's agency. Section <br /> 1111C(2)(d)and Section 1115B of the Ethics Code provide in pertinent part: <br /> §1111. Payment from nonpublic sources <br /> C.Payments for nonpublic service <br /> + se <br /> (2) No public servant and no legal entity in which the public servant exercises control or <br /> owns an interest in excess of twenty-five percent, shall receive any thing of economic <br /> value for or in consideration of services rendered, or to be rendered, to or for any person <br /> during his public service unless such services are: <br /> xx � <br /> (d) Neither performed for nor compensated by any person from whom such public <br /> servant would be prohibited by R.S. 42:1115(A)(1)or(B)from receiving a gift. <br />
