ISSUE N0.3:NEIL J.BERNARD'S REQUIRED FINANCIAL DISCLOSURES <br /> In the event the Church or the Corporation enter into any agreements with the School Board, the <br /> Code will require Neil J. Bernard to file an annual financial disclosure with the Board. <br /> La. R.S. 42:1114 provides that each public servant and each member of his immediate family <br /> who derives anything of economic value, directly, through any transaction involving the agency <br /> of such public servant or who derives any thing of economic value of which he may be <br /> reasonably expected to know through a person which (1) is regulated by the agency of such <br /> public servant, or(2) has bid on or entered into or is in any way financially interested in any <br /> contract,subcontract,or any transaction under the supervision or jurisdiction of the agency <br /> of such public servant shall disclose certain information as set forth in Section 1114. <br /> Accordingly, if the Church enters into any contracts or agreements with the School Board,Neil J. <br /> Bernard is required to file an annual report by May 15th disclosing the amount of income he <br /> received from the Church or the Corporation.Form 405 may be found at ethics.la.gov/disclosures. <br /> CONCLUSION <br /> The Board concluded, and instructed me to inform you, that the Code does not prohibit the <br /> Corporation or the Church from entering into agreements with the School Board, provided that <br /> neither Kristen Mamou, nor Neil J. Bernard, provide the services associated with the agreements <br /> with the School Board. <br /> The Board further concluded, and instructed me to inform you, that if such agreements exist, both <br /> Samuel Mamou and Kristen Mamou are prohibited by the Code from receiving compensation from <br /> the Corporation or the Church for the rendering of services by Kristen Mamou as an employee. <br /> Finally, the Code will require Neil J. Bernard to file an annual report by May 15th disclosing the <br /> amount of income he received from the Corporation or the Church. <br /> This advisory opinion is based solely on the facts as set forth herein. Changes to the facts as <br /> presented may result in a different application of the provisions of the Code of Governmental <br /> Ethics.
