As a Program Monitor within the Office of Public Health for LDH, you are a public servant <br /> pursuant to La. R.S. 42:1102(19). Your agency is OPH pursuant to La. R.S. 42:1102(2)(a)(i). <br /> Pursuant to La. R.S. 42:1113A(1)(a), you cannot enter into any contract or transaction under the <br /> supervision or jurisdiction of OPH. You are not prohibited from providing contractual services to <br /> other state agencies as a private contractor, provided that the contract or transaction is not under <br /> the jurisdiction or supervision of OPH. <br /> Pursuant to La. R.S. 42:1111C(2)(d), you cannot receive compensation for services rendered to or <br /> for any company that has or is seeking to have a contractual or other business or financial <br /> relationship with OPH. Therefore, if OPH contracts with a company to provide First Aid or CPR <br /> training services, you cannot receive any compensation from said company. Likewise, you cannot <br /> receive compensation from any company that has any contractual or other business or financial <br /> relationship with OPH. <br /> CONCLUSION <br /> The Board concluded and instructed me to inform you that the Code prohibits you from entering <br /> into any contract or transaction that is under the supervision or jurisdiction of the Office of Public <br /> Health within the Louisiana Department of Health and also prohibits you from receiving <br /> compensation from any company that has a contractual or other business or financial relationship <br /> with the Office of Public Health. <br /> This advisory opinion is based solely on the facts as set forth herein. Changes to the facts as <br /> presented may result in a different application of the provisions of the Code of Governmental <br /> Ethics.
