Hano <br /> Livingston Parish Fire Protection District No. 10 <br /> PO Box 250 <br /> Holden, Louisiana 70744 <br /> Re: Docket No. 2025-164 <br /> Advisory Opinion <br /> Dear Mr. Hano: <br /> The Louisiana Board of Ethics, at its meeting on May 2, 2025, considered your request for an <br /> advisory opinion on behalf of the Livingston Parish Fire Protection District No. 10("Fire District") <br /> as to whether the Code of Governmental Ethics("Code")permits BFA of Louisiana, Inc., (`BFA") <br /> to continue to contract for goods and services with Fire District. <br /> FACTS PROVIDED <br /> Dale Hayden has served on the Fire District Board since January 25, 2024. He began employment <br /> with BFA in March 2024 and currently serves as the Regional Sales Manager for New Apparatus <br /> Sales covering Louisiana and Mississippi. You ask whether the Fire District may continue to <br /> accept bids from and award contracts to BFA while Mr. Hayden serves on the Board. <br /> LAW <br /> La.R.S. 42:1111C(2).No public servant and no legal entity in which the public servant exercises <br /> control or owns an interest in excess of twenty-tive percent, shall receive any thing of economic <br /> value for or in consideration of services rendered, or to be rendered, to or for any person during <br /> his public service unless such services are: <br /> (d)Neither performed for nor compensated by any person from whom such public servant <br /> would be prohibited by R.S. 42:1115(A)(1) or(B) from receiving a gift. <br /> La. R.S. 42:1115A.
