The Board found James King, in his capacity as an appointed member of the Board of Commissioners of the Concordia Parsih Hospital Service District Number One, violated La. R.S. 42:1112B(5) by particiapting in three transactions involving the Concordia Parsih Hospital Service District Number One in which Dr. Dulam had a substantial economic interest at a time when Dr. Dulam was a party to an existing contract with Mr. King and by reason thereof was in a position to directly affect Mr. King's economic interests.

Ethics Board Docket No. 2024-119 <br /> Page 4 of 9 <br /> approve contractual agreements between the Hospital District and Dr. Dulam on three (3) <br /> occasions, specifically on February 22, 2022, October 25, 2022,and October 24, 2023. <br /> IV. <br /> PR4VISIONS OF LAW: <br /> l. <br /> Section 1112B(5} of the Ethics Code prohibits a public servant from participating in a <br /> transaction involving the governmental entity in which,to his actual knowledge,any person, who <br /> is a party to an existing contract with such public servant and by reason thereof is in a position to <br /> directly affect the�conomic interests of such public servant,has a substantial economic interest. <br /> §1112. <br /> B. No put�lic servant, except as provided in R.S. 42:1120, shall participate in a <br /> transaction involving the governmental entity in which, to his actual knowledge, <br /> any of the following persons has a substantial economic interest: <br /> (5) Any person who is a party to an existing contract with such public servant, or <br /> with any legal entity in which the public servant exercises control or owns an <br /> interest in excess af twenty-fiv�percent, or who owes any thing of econamic value <br /> to such public servant, or to any legal entity in which the public servant �xercises <br /> control or owns an interest in excess of twenty-five percent, and who by reason <br /> thereof is in a position to affect directly the economic interests of such public <br /> servant. <br /> 2. <br /> The following terms are defined in Section 1102 of the Ethics Code and are relevant when <br /> analyzing the above Sections: <br /> (2)(a) "Agency" means a department, office,division, agency, commission,board, <br /> committee, or other organizational unit of a governmental entity. <br /> (12) "Governmental entity" means the state or any political subdivision which <br /> employs the public employee or employed the former public employee or to which <br /> the elected official is elected, as the case may be. <br />
