ISSUE NO.2: SERVICES TO SCHOOL DISTRICTS <br /> You intend to provide training workshops/seminars and perform public speaking on various topics <br /> for local school districts. These topics will include leadership, diversity, data, school turnaround, <br /> team building, classroom management, and professional learning on communities, climate, and <br /> culture. You stated that you will not provide training or perform public speaking on topics related <br /> to homelessness or parent and family engagement. <br /> La. R.S. 42:1113A(1)(a) states no public servant...or legal entity in which he has a controlling <br /> interest shall bid on or enter into any contract, subcontract, or other transaction that is under the <br /> supervision or jurisdiction of the agency of such public servant. <br /> Generally, La. R.S. 42:1113(A)(1)(a) prohibits you from entering into any transactions which are <br /> under the supervision and jurisdiction of your agency, the LDOE Division of Federal Support and <br /> Grantee Relations. However, La. R.S. 42:1113(A)(1)(a) does not prohibit you from entering into <br /> transactions with local school districts to provide workshop training and public speaking seminars, <br /> since those transactions are not under the supervision and jurisdiction of your agency.Additionally, <br /> La. R.S. 42:1111C(2)(d) does not prohibit you from receiving any thing of economic value for or <br /> in consideration of services rendered, or to be rendered,to or for any local school district because <br /> a school district is not considered a"person"for purposes of the Code. - <br /> CONCLUSION <br /> The Board concluded, and instructed me to inform you, that the Code does not prohibit you from <br /> providing tutoring and mentoring services to individual students, parents, teachers, or principals. <br /> Additionally, the Code does not prohibit you from providing training workshops/seminars and <br /> performing public speaking to local school districts on various topics unrelated to homelessness <br /> or parent and family engagement. You should seek an updated advisory opinion if any potential <br /> client presents a possible violation of these Code provisions. <br /> This advisory opinion is based solely on the facts as set forth herein. Changes to the facts as <br /> presented may result in a different application of the provisions of the Code of Governmental <br /> Ethics.
