La. R.S. 42:1102(19)defines a"public servant" as a public employee or an elected official. <br /> La.R.S.42:1102(21)defines"Substantial economic interest"to mean an economic interest which <br /> is of greater benefit to the public servant or other person than to a general class or group of <br /> persons... <br /> La. R.S. 42:1153(B)provides with respect to any penalties: <br /> Upon a determination that any public employee or other person has violated any <br /> provision of any law within the jurisdiction of the Board of Ethics except violations of <br /> the Campaign Finance Disclosure Act which shall be governed by Chapter 11 of Title <br /> 18 of the Louisiana Revised Statutes of 1950, the Ethics Adjudicatory Board may <br /> remove, suspend, or order a reduction in pay, or demotion of the public employee or <br /> other person, or impose a fine of not more than ten thousand dollars, or both. <br /> V. <br /> OPINION: <br /> Terry Campbell in his capacity as executive director of LPHA, was a public servant as <br /> defined by the Code. Terry Campbell had certain duties and responsibilities as Executive Director <br /> of LPHA, Including, but not limited to, contracting and paying individuals to maintain the <br /> propertys under the LPHA control. In that capacity, he signed seven checks paying to his brother- <br /> in- law George Carraway, from July 18, 2017 to February 20, 2018, for work on LPHA property <br /> totaling. <br /> It is the opinion of the BOE that Terry Campbell, in his capacity as the Executive Director <br /> of LPHA,violated La. R.S. 42:1112B when he participated in transactions involving the LPHA in <br /> which his brother-in-law, George Carroway,had a substantial economic interest,by signing checks <br /> on behalf of LPHA made payable to his brother-in-law, George Carraway, for the repair of <br /> property regulated by LPHA. <br /> Page 5 of 9 <br />
