Waiver request submitted by Cynthia Fulton Solomon, a former member of the Kingswood Improvement District, regarding a $1,500 late fee assessed for filing her 2013 Tier 2.1 Annual PFD 278 days late.
Facts:
Ms. Solomon states that she stopped attending meetings in the early part of 2013. She thought that because she was no longer involved with the District, she was not required to file a disclosure statement. She states that the District contacted her in August 2014 requesting that she file a formal letter of resignation. She complied. Ms. Solomon also states that her family is experiencing "...tough financial times" and believes the imposition of a late fee would cause a hardship. Correspondence was sent to Ms. Solomon on May 10, 2016, requesting that she submit supporting documentation.

Ms. Solomon submitted information stating that she is employed as a substitute medical health counselor for the St. Tammany Parish School Board. She can only work a maximum of 20 hours a week, but does not always work the maximum. She does not receive any benefits but can pay into a retirement account. She provided her W-2 that show wages of $20,000.

Law:
La. R.S. 42:1124.2.1 requires financial disclosure for each member and designee of a board or commission which has the authority to expend, disburse or invest $10,000 or more of funds in a fiscal year on or before May 15th of each year during which the person holds office and the year following termination of the holding of such office.
La. R.S. 42:1124.4 of the Code provides that upon discovery of the failure to file, failure to timely file, omission of information or inaccurate information, the Board shall notify the filer by sending him a notice of delinquency by certified mail. The notice of delinquency shall inform the person that the financial statement must be filed, or that the information must be disclosed or accurately disclosed, or that a written answer contesting the allegation of such failure, omission, or inaccuracy must be filed no later than seven (7) business days after receipt of the notice of delinquency.
Recommendations:
Suspend all but $250 based on future compliance with the reporting requirements under the Code of Ethics. Offer a payment plan.
