RE:
Waiver request submitted by Steven Verlin Slaton, Board of Veterinary Medicine, regarding a $1,500 late fee assessed for filing his 2013 Tier 2.1 annual PFD 107 days late.
Facts:
Dr. Slaton states that he did not receive the initial NOD that was issued in January 2015. He requested that a copy of the green card be sent to him. The green card receipt was scanned and sent to Dr. Slaton via email. He reviewed the signature and discussed the matter with his wife. Mrs. Slaton states that she did not receive, nor did she sign for the NOD. Dr. Slaton has attached a page with his wife's signature. He states that a comparison of the signatures will show that his wife did not sign for the NOD.

It should be noted that Robbie Slaton signed for both the NOD and Late Fee Order and both signatures look similar. Neither Dr. Slaton nor Mrs. Slaton dispute they received the Late Fee Order or that Mrs. Slaton did not sign for it. Another green card was received that was signed for by Mrs. Slaton, that again, is similar to the NOD and Late Fee Order signatures. It does not appear the sample signatures sent in is the signature used by Mrs. Slaton on any of the green cards received, but staff still asserts that it is her signature.

Law:
La. R.S. 42:1124.2.1 requires financial disclosure for each member and designee of a board or commission which has the authority to expend, disburse or invest $10,000 or more of funds in a fiscal year on or before May 15th of each year during which the person holds office and the year following termination of the holding of such office.
La. R.S. 42:1124.4 of the Code provides that upon discovery of the failure to file, failure to timely file, omission of information or inaccurate information, the Board shall notify the filer by sending him a notice of delinquency by certified mail. The notice of delinquency shall inform the person that the financial statement must be filed, or that the information must be disclosed or accurately disclosed, or that a written answer contesting the allegation of such failure, omission, or inaccuracy must be filed no later than seven (7) business days after receipt of the notice of delinquency.
