| Advisory opinion request regarding whether the Code of Governmental Ethics would prohibit Southeastern University Associate Professor, Amber Narro, from utilizing the Southeastern Logo license she has acquired to produce items for sale at area establishments |

Ms. Narro is a professor at Southeastern University. Ms. Narro provided that her husband is the full-time Golf Coach for the University. Ms. Narro would not be selling to the University, only to private businesses. She provided that she went through proper licensing protocol with Learfield Licensing and used her personal funds to acquire the license, and she pays an annual fee of about $200 to maintain it. Ms. Narro added that to date, she has not sold any items with the logo on it for-profit. So far, she has only utilized the logo on items that she made to sell at fundraisers for the golf team. Ms. Narro stated that the private businesses that she anticipates doing business with do not have contracts with the University. Generally, they are small boutiques and restaurants. Further, Ms. Narro would not be selling any items to the University.

La. R.S. 42:1111C(2)(d) prohibits a public servant and a legal entity in which the public servant exercises control or owns an interest from receiving any thing of economic value for services rendered to or for any person during his public service unless such services are neither performed for nor compensated by any person from whom such public servant would be prohibited by La. R.S. 42:1115(A)(1) or (B) from receiving a gift.
La. R.S. 42:1115A(1) prohibits a public servant from soliciting or accepting, directly or indirectly, any thing of economic value as a gift or gratuity from any person or from any officer, director, agent, or employee of such person, if such public servant knows or reasonably should know that such person has or is seeking to have a contractual, business or financial relationship with the public servant's agency.
