Advisory opinion regarding whether the post-employment restrictions prohibit Governor's Office of Homeland Security and Emergency Preparedness (GOHSEP) employee, Bernard M. Plaia, Jr., from seeking employment as an insurance analyst once he retires from GOHSEP.
Facts:
Mr. Plaia provided that he has been employed by GOHSEP since 2007. Mr. Plaia stated that he currently serves as a staff attorney for the Disaster Recovery Unit. Mr. Plaia provided that he does not serve as an agency head for the Disaster Recovery Unit. Mr. Plaia's job duties included working with applicants for the FEMA Public Assistance and Hazard Mitigation Programs. Mr. Plaia has not provided insurance analysis as part of his job duties as a staff attorney for GOHSEP.

Mr. Plaia would like to accept a position with a firm after he retires from GOHSEP as an insurance analyst. He would be hired to analyze and evaluate project worksheets, insurance policies and FEMA auditing guidelines in order to determine if FEMA mistakenly withheld funds from applicants. Mr. Plaia stated that he has never performed this task before. Mr. Plaia added that as an insurance analyst, he would not be transacting business with the Disaster Recovery Unit of GOHSEP.
Law:
La. R.S. 42:1121B(1) prohibits a public servant, for a period of two years following the termination of his public employment, from assisting a person for compensation in a transaction in which he participated or from rendering any service which such former public employee rendered to the agency during the term of his public employment on a contractual basis, regardless of the parties to the contract, to, for, or on behalf of the agency with which he was formerly employed.
Recommendations:
Adopt draft advisory opinion.
