Advisory opinion request from the Central Community School System regarding whether Elizabeth Hager, the daughter of Amelia McLin, the Director of Central's Special Education Department, may be employed as a special education paraprofessional at Tangelwood Elementary.
Facts:
Ms. Amelia McLin serves as the Director of Central's Special Education Department. As part of Ms. McLin's job duties, she assists schools in the supervision of teachers and specialists assigned to the special education program. However, Ms. McLin does not supervise the paraprofessional. Ms. McLin's daughter has applied to fill an opening at Tanglewood Elementary as a paraprofessional in special education.
As a paraprofessional at Tanglewood Elementary, Ms. Hager, would be exclusively supervised by Ms. Julie Stevens, the principal. Pursuant to Central's policy, the interviews of all applicants for the paraprofessional position would be conducted by the principal. The principal would then make a recommendation to the superintendent. The superintendent would generally accept the recommendation of the principal.
Law:
La. R.S. 42:1102(13) defines "immediate family" as the term relates to a public servant to mean his children, the spouses of his children, his brothers and their spouses, his sisters and their spouses, his parents, his spouse, and the parents of his spouse.

La. R.S. 42:1112B(1) states that no public servant shall participate in a transaction involving the governmental entity in which, to his actual knowledge, any member of his immediate family has a substantial economic interest.

La. R.S. 42:1119 A. No member of the immediate family of an agency head shall be employed by his agency.

Recommendations:
Adopt draft advisory opinion.
