RE:
Waiver request submitted by Michael Dean Slocum, former member of the Louisiana Board of Pardons, regarding a $2,500 late fee assessed for filing his amended 2013 Tier 2 annual PFD 279 days late.
Facts:
Mr. Slocum states that he filed a Tier 2.1 PFD because that was the tier level he had been filing in the past. He states that he was not informed of the change in tier level because at the time the PFD was due (5/15/14), he was no longer serving on the Board (resigned 2/18/14).

Acts 2012, No. 714 restructured the Board of Pardon and also changed the tier level for its members to file, i.e., no longer file a Tier 2.1 and file a Tier 2 (effective August 2012).

Mr. Slocum states that he did not respond to the Notice of Delinquency because when he contacted the personnel at the Board of Pardon he was told (by Linda) that everything was taken care of.

Law:
La. R.S. 42:1124.2 requires each person holding a public office who represents a voting district having a population of 5,000 or more persons to file an annual personal financial disclosure statement on or before May 15th of each year during which the person holds office and the year following termination of the holding of such office.
La. R.S. 42:1124.4 of the Code provides that upon discovery of the failure to file, failure to timely file, omission of information or inaccurate information, the Board shall notify the filer by sending him a notice of delinquency by certified mail. The notice of delinquency shall inform the person that the financial statement must be filed, or that the information must be disclosed or accurately disclosed, or that a written answer contesting the allegation of such failure, omission, or inaccuracy must be filed no later than seven (7) business days after receipt of the notice of delinquency.
Recommendations:
Suspend all based on future compliance with the disclosure requirements under the Code of Ethics.
