Advisory opinion request by Wildred Kinnerson, Chairman of the St. Landry Parish Fire District No. 3, whether Terri Courvelle may serve as a member of the St. Landry Parish Fire District No. 3 Board of Commissioners (District Board), while her brother-in-law and husband are employed by the District.
Facts:
Terri Courvelle was appointed by the St. Landry Parish Council to the District Board in February of 2016. Matthew Rabalais, an employee of the District for ten years, is married to Ms. Courvelle's sister. David Courvelle has been with the District for twenty-six years. He is married to Terri Courvelle. The District Board has the ability to hire, fire, and set the salary of employees of the District. The chairman of the District Board signs off on the checks to the employees.
Law:
La. R.S. 42:1113A(1)(a) of the Code prohibits a public servant, a public servant's immediate family, or a legal entity in which he has a controlling interest from bidding on or entering into any contract, subcontract, or other transaction that is under the supervision or jurisdiction of the agency of such public servant. La. R.S. 42:1119B(1) prohibits a member of an immediate family of a member of a governing authority or the chief executive of a governmental entity from being employed by the governmental entity.

La. R.S. 42:1119C(2) allows for the continued employment and receipt of normal promotional advancements by public employees who have been employed for at least one year prior to the member of the public employee's immediate family becoming an agency head.

La. R.S. 42:1112(B) prohibits a public servant from participating in a transaction in which the public servant or member of his immediate family has a substantial economic interest.
Recommendations:
Adopt proposed advisory opinion.
