| Advisory opinion request by Jim DiFatta, Chairman of the St. Bernard Parish Hospital Service District Board of Commissioners, regarding whether the St. Bernard Parish Hospital Board may employ Wayne J. Landry as Executive Director for the St. Bernard Parish Hospital. |

Mr. Landry served on the Hospital Service District Board from 2009 until his resignation on May 20, 2014. Mr. Landry sent his resignation letter dated May 19, 2014 to the St. Bernard Parish Council stating his resignation was effective on May 20, 2014 at 3:00 p.m.
He is a potential candidate for the Executive Director of the St. Bernard Parish Hospital.

La. R.S. 42:1121A(2) provides that no former member of a board or commission shall, for a period of two years following the termination of his public service on such board or commission, contract with, be employed in any capacity by, or be appointed to any position by that board or commission.
La. R.S. 42:1102(18)(c) provides that the termination of any particular term of employment of a public employee shall take effect on the day the termination is clearly evidenced.
