Advisory opinion request from John Vincent II regarding whether he may work as a contract employee for companies that have partnered with Belle Chasse Academy to provide after-school programs while his daughter-in-law is in charge of providing the after-school programs.
Facts:
April Vincent is John Vincent's daughter-in-law and is in charge of the after-school programs at Belle Chasse Academy. She applied for a grant through the Louisiana Department of Education to provide the programs. In the application, Belle Chasse Academy agreed to partner with American Defense Services, Inc. and Risk Concepts of Louisiana, Inc. These companies would develop and hire instructors to deliver the courses at the schools.

Mr. Vincent stated that he is an expert in curriculum development. He has no ownership in either of the companies that have signed letters of intent to provide the services to Belle Chasse Academy. The only compensation he would receive from either company would be as a 1099 contract employee in developing the training courses or to be an instructor for one or more of the courses to be presented.
Law:
La. R.S. 42:1113A(1)(a) of the Code prohibits a public servant, a public servant's immediate family, or a legal entity in which he has a controlling interest from bidding on or entering into any contract, subcontract, or other transaction that is under the supervision or jurisdiction of the agency of such public servant.
Recommendations:
Adopt proposed advisory opinion.
