RE:
Advisory Opinion request from Jennifer A. Mitchell with the University of Louisiana System, and her law firm Pearson and Mitchell, regarding entering into a contract with the City of New Orleans.
Facts:
Jennifer Mitchell is employed by the University of Louisiana System as the Director of Governmental Affairs. She is also a co-owner of the law firm, Pearson and Mitchell LLC. Ms. Mitchell's firm is certified as a Disadvantaged Business Enterprise ("DBE") with the City of New Orleans, which recently issued a Request for Proposal in connection with an Intergovernmental Affairs Contract. The contract requires that a certified DBE be included in order for a majority company to submit a bid for the contract. Ms. Mitchell stated that she will not receive any compensation from the work to be performed on the Intergovernmental Affairs Contract with the City of New Orleans.Ms. Mitchell further stated that she will not participate in any lobbying, or advocating of the Legislature on behalf of the Intergovernmental Affairs Contract.
Law:
La. R.S. 42:1113A(1)(a) provides that no public servant and no legal entity in which he has a controlling interest shall bid on or enter into any contract, subcontract, or other transaction that is under the supervision or jurisdiction of the public servant's agency

La. R.S. 24:56F(1) provides that no state employee in his official capacity or on behalf of his agency shall lobby for or against any matter intended to have the effect of law pending before the Legislature or any committee thereof.


Recommendations:
Adopt the proposed advisory opinion.
