Request for an advisory opinion from Roddy Bergeron a potential candidate for Lafayette City-Parish Council relative to a possible ethics conflict involving his brother, Brian Bergeron, an employee for Patriot Construction.
Facts:
Roddy Bergeron is contemplating running for Lafayette City-Parish Council. Mr. Bergeron's brother, Brian Bergeron, is a project manager for Patriot Construction which has performed and could possibly perform future construction projects for Lafayette Consolidated Government (LCG). Brian Bergeron does not have any ownership in Patriot Construction and is considered a regular, salaried employee.
Law:
La. R.S. 42:1112B(1) prohibits a public servant, except as provided in R.S. 42:1120, from participating in a transaction involving the governmental entity in which, to his actual knowledge, any immediate family member has a substantial economic interest.

La. R.S. 42:1113A(1)(a) prohibits a public servant, immediate family member or business in which the public servant or members of his immediate family have a controlling interest from bidding on or entering into any contract, subcontract, or other transaction that is under the supervision or jurisdiction of the agency of such public servant.

Recommendations:
Adopt the proposed advisory opinion.
