RE:
Request for an advisory opinion from John Ryan Vivian, a former attorney with the Louisiana Department of Transportation and Development, relative to post-employment restrictions.
Facts:
John Ryan Vivian was employed as an Attorney 3 with the Louisiana Department of Transportation and Development (DOTD) until his termination in April 2018. As an Attorney 3, Mr. Vivian represented DOTD in matters involving expropriation of property for highway purposes, mainly concerned with property situated in Northeast and Central Louisiana.

Mr. Vivian has been approached by a property owner in East Baton Rouge Parish regarding the expropriation of property along I-10. Representation of the property owner would include services negotiating with DOTD as to the acquisition of the property.


While employed with DOTD, Mr. Vivian was never involved in any cases in East Baton Rouge, nor was he involved in matters involving the I-10 expansion project.


Law:
La. R.S. 42:1121B(1) prohibits a former public employee who was not an agency head, elected official, or member of a board or commission, for a period of two years following the termination of his public employment, from assisting another person, for compensation, in a transaction, or in an appearance in connection with a transaction in which such former public employee participated at any time during his public employment and involving the governmental entity by which he was formerly employed, or for a period of two years following termination of his public employment, rendering any service which such former public employee had rendered to the agency during the term of his public employment on a contractual basis, regardless of the parties to the contract, to, for, or on behalf of the agency with which he was formerly employed.
Recommendations:
Adopt the proposed advisory opinion.
