Waiver request submitted by Heather A Stefan, former member of the Work Force Development Board / #21, regarding a $1500 late fee assessed for filing her 2017 Tier 2.1 annual pfd 47 days late.
Facts:
Heather A.Stefan is requesting a waiver for the following reasons:

Ms. Stefan stated the Work Force Development Board normally reminds board members repeatedly about submitting the Financial Disclosure Statement. However, due to staff issues she only received one reminder that year via email and no one at the board brought it to her attention thereafter.

Ms.Stefan stated it took the state 2 years to bring her accidental failure to file to her attention; and she believes it is fair to grant her a waiver. Ms. Stefan stated she was diagnosed with cancer in 2017, which forced her to miss meetings when reminders may have been provided in person. She missed almost three months of work non-consecutively due to her diagnosis and during that time her focus was on her health.


Ms.Stefan stated the NOD received in November, 2019 was received by one of her children, who placed the letter where she normally does not put the mail; and as a result, she did not find the notice until after the holidays. She stated she never missed submitting a financial disclosure before or since then. Ms.Stefan stated she does not have the funds to pay the $1500 late fee; paying this late fee would be a significant hardship on her.

Law:
La. R.S. 42:1124.2.1 requires financial disclosure for each member and designee of a board or commission which has the authority to expend, disburse or invest $10,000 or more of funds in a fiscal year on or before May 15th of each year during which the person holds office and the year following termination of the holding of such office.

La. R.S. 42:1124.4 of the Code provides that upon discovery of the failure to file, failure to timely file, omission of information or inaccurate information, the Board shall notify the filer by sending him a notice of delinquency by certified mail. The notice of delinquency shall inform the person that the financial statement must be filed, or that the information must be disclosed or accurately disclosed, or that a written answer contesting the allegation of such failure, omission, or inaccuracy must be filed no later than seven (7) business days after receipt of the notice of delinquency.

Recommendations:
Suspend all based on future compliance with the Code of Ethics.
