Waiver request submitted by Nathan Barrett, former member of the Success Preparatory Academy Charter School, regarding a $1500 late fee assessed for filing his 2017 Tier 3 annual PFD 422 days late.
Facts:
Nathan Barrett is requesting a waiver for the late filing of his PFD Statement for the following reasons:

He served on the board from 2015 to 2018, then resigned during the Fall of 2018, when he relocated out of state. He was living in Washington D.C. when the NOD was issued. He forwarded his mail with the postal service, but never received the notice. Once informed by the Success Prep that he failed to file the 2017 disclosure, he immediately submitted the forms. However, without this notice, he was unaware of the deficiency. He understands that public service comes with responsibilities such as compliance with the Louisiana Code of Ethics and his initial failure to file the 2017 disclosure was an oversight, but not an intentional act. He currently works for a non-profit, the National Alliance for Public Charter Schools, and the assessment of this late fee would have a significant impact on his family. Mr. Barrett asks the Ethics Board to consider his lack of notice and waive or reduce his penalty.

Law:
La. R.S. 42:1124.3 requires persons holding a public office who represent a voting district having a population of less than 5,000 and each member of the governing authority or management board of a charter school created pursuant to Chapter 42 of Title 17 of the Louisiana Revised Statutes of 1950 to file a financial disclosure statement on or before May 15th of each year during which the person holds office and the year following termination of the holding of such office.

La. R.S. 42:1124.4 of the Code provides that upon discovery of the failure to file, failure to timely file, omission of information or inaccurate information, the Board shall notify the filer by sending him a notice of delinquency by certified mail. The notice of delinquency shall inform the person that the financial statement must be filed, or that the information must be disclosed or accurately disclosed, or that a written answer contesting the allegation of such failure, omission, or inaccuracy must be filed no later than seven (7) business days after receipt of the notice of delinquency.

Recommendations:
Suspend all based on future compliance with the Code of Ethics.
