Waiver request submitted by Tanya Dix, Elan Academy Charter School/Orleans Parish, regarding a $1500 late fee assessed for filing her amended 2017 Tier 3 Annual PFD 162 days late.
Facts:
Tanya Dix is requesting a waiver for the late filing of her 2017 PFD Statement for the following reasons:

Ms. Dix stated that being an educator for over 15 years, she thought it would be a great idea to do some community service work. She applied to become a board member at a new charter school and was selected to be a board member. Her role was voluntary. She was not elected, and she did not receive a salary or payment of any type for serving as a board member. Being the only Louisiana State Certified Educator on the board, she was nominated to be the Academic Committee Chair, which required additional responsibilities. This was her first time serving as a member, and she was not informed or aware of the filing requirements. However, once she was notified of the delinquency, she filed her disclosures immediately.

As an educator, she does not make a large salary and honestly cannot afford to pay a $1500 late fee "for something that was sincerely unintentional". Her husband has been out of work since March 22, 2020, due to the COVID-19 state mandates. Having to pay the late fee would cause a financial hardship on her and her family. She would appreciate if the Ethics Board would waive her late fee assessment.

Law:
La. R.S. 42:1124.3 requires persons holding a public office who represent a voting district having a population of less than 5,000 and each member of the governing authority or management board of a charter school created pursuant to Chapter 42 of Title 17 of the Louisiana Revised Statutes of 1950 to file a financial disclosure statement on or before May 15th of each year during which the person holds office and the year following termination of the holding of such office.

La. R.S. 42:1124.4 of the Code provides that upon discovery of the failure to file, failure to timely file, omission of information or inaccurate information, the Board shall notify the filer by sending him a notice of delinquency by certified mail. The notice of delinquency shall inform the person that the financial statement must be filed, or that the information must be disclosed or accurately disclosed, or that a written answer contesting the allegation of such failure, omission, or inaccuracy must be filed no later than seven (7) business days after receipt of the notice of delinquency.


Recommendations:
Suspend all based on future compliance with the reporting requirements under the Code of Ethics.
