Request that the Board waive a $2,000 campaign finance late fee assessed against Fredrick Michael Cramer, a candidate for Coroner for East Feliciana Parish, in the October 12, 2019 election, whose 10-G campaign finance disclosure report was filed 215 days late.
Facts:
Fredrick Michael Cramer requests a waiver and states the following:

He received a message from his previous landlord that an item was delivered via certified mail to him at his former address. He was not there because five days after the completion of his one term as Coroner of East Feliciana Parish, he transferred records of the Coroner's Office to his successor and returned to Texas for medical reasons. When notification was received from his landlord and after his inquiry as to cause, he immediately completed the required report. Since the election of Coroner was completed in the 2019 primary, he didn't think a general election disclosure was necessary. Also, since he did not campaign or collect money, such a form seemed totally unnecessary. Sometime during his tenure as Coroner he was diagnosed with cancer. That is why he has relocated to Texas and returned to his alma mater, M.D. Anderson Hospital.

18:1505.4.A(1) Any candidate, the treasurer or chairman of a political committee, or any other person required to file any reports under this Chapter, who knowingly fails to file or who knowingly fails to timely file any such reports as are required by this Chapter may be assessed a civil penalty for each day until such report is filed.

Section 1205C of the Rules for the Board of Ethics provides that "[i]f a report is filed more than 10 days late and the amount of activity on the report is less than the amount of the late fee to be assessed, the staff may reduce the late fee to the amount of activity or 10 times the per-day penalty, whichever is greater."

Recommendations:
Reduce to $600 based on Rule 1205C; decline to waive.
