Waiver request submitted by Willis Eugean Garner, a member of Natchitoches Parish School Board, regarding a $250 late fee assessed for filing his 2019-2020 School Board Disclosure Statement 5 days late.
Facts:
Willis E. Garner requests a waiver and states the following:
During the time the NOD was received, he was moving his elderly parents into a nursing facility in Winnfield, Louisiana. He and his brother were caring for their parents at their home on a rotating schedule. The doctor caring for his parents ordered that they needed 24-hour care, so he had to make the decision and place his parents in the Autumn Leaves Nursing Home. Garner stated this "turmoil and stress" consumed a lot of his time and was overwhelming. Along with dealing with his personal issues, he was constantly going back-and- forth to the school in Natchitoches (over 30 miles away, 1 direction from his home) since he was assisting with the new school year startup. He's also the Water Superintendent for the Goldonna Water System and Che Che Bay District Water System. His water district duties require him to take daily samples and make adjustments to the water as needed to ensure the water provided is clean and safe for customers. With his various school board duties, water system duties, and his parents, his plate was full. With all the issues he had going on, filing the disclosure slipped his mind. He asks the Ethics Board to please have compassion and take into consideration his personal problems during that time and waive his late fee.

Law:
La. R.S. 42:1119B(2)(a)(iii) requires that within thirty days after the beginning of each school year, any school board member or superintendent whose immediate family member is employed by the school board shall file a disclosure statement with the Board of Ethics stating the facts of such employment. Any person who fails to timely file a disclosure statement may be assessed a late fee of fifty dollars per day, not to exceed $1,500.
Recommendations:
Waive the late fee.
