A Request for an Advisory Opinion, submitted by Luke H. Abrusley, regarding whether the Louisiana Code of Governmental Ethics ("Code") would prohibit his company (LHA Rentals Oberlin, LLC) from purchasing property and continuing a lease to the Louisiana Department of Children and Family Services after he resigned from the Allen Parish District Attorney's Office.
Facts:
Mr. Abrusley is currently an Assistant District Attorney in Allen Parish and has served in that role since May 2009. He prosecutes the Juvenile Delinquency Docket and assists in matters with the Department of Children and Family Services. He will be resigning from that position on December 31, 2020, in order to commence his term as City Judge in Oakdale, Louisiana. He is also the sole owner of various limited liability companies, including LHA Rentals Oberlin, LLC. As the sole owner of LHA Rentals Oberlin, LLC, he has agreed to purchase a building that is currently leased to the Louisiana Department of Children and Family Services. He wishes to purchase the property after he resigns from the District Attorney's Office and continue the lease with the Louisiana Department of Children and Family Services.
