Request to reconsider the Board's decision to suspend all but $650 based on future compliance of a $1500 late fee assessed against Gerrin John Narcisse, Lacombe Recreation District #4, for filing his 2018 Tier 2.1 Annual PFD 149 days late.
Facts:
Mr. Narcisse reiterates his prior reasons for the waiver request. He also states that at the same time, he was running for council member with little staff and funding. He states the reporting requirements got mixed up and when he received the NOD he disregarded it because he had already filed his campaign finance reports. He states he has already paid late fees associated with those late filings. He states his daughter was born two weeks after the October election causing a shift in lifestyle and focus.


Initial Waiver Request:


Jordan Johnson, Executive Directory of the St. Tammany Recreation District 4 in Lacombe, Louisiana is seeking a Waiver Request on behalf of Gerrin Narcisse.

Mr. Johnson stated Gerrin Narcisse completed his 2018 Personal Financial Disclosure Statement prior to the May 15, 2019 deadline and the filing was in Mr. Narcisse's folder at the St. Tammany Recreation District office. Neither Mr. Narcisse, nor Mr. Johnson were aware that the disclosures had to be submitted to the Ethics Agency each year. They were under the impression the disclosures needed to be completed and kept on file for auditing purposes.

He formally requests the Ethics Board to waive Mr. Narcisse's late fee assessment based on this information.

Law:
La. R.S. 42:1124.2.1 requires financial disclosure for each member and designee of a board or commission which has the authority to expend, disburse or invest $10,000 or more of funds in a fiscal year on or before May 15th of each year during which the person holds office and the year following termination of the holding of such office.

La. R.S. 42:1124.4 of the Code provides that upon discovery of the failure to file, failure to timely file, omission of information or inaccurate information, the Board shall notify the filer by sending him a notice of delinquency by certified mail. The notice of delinquency shall inform the person that the financial statement must be filed, or that the information must be disclosed or accurately disclosed, or that a written answer contesting the allegation of such failure, omission, or inaccuracy must be filed no later than seven (7) business days after receipt of the notice of delinquency.

Recommendations:
Affirm prior decision to suspend all but $650 based on future compliance with the Code of Ethics. The $650 is payable within 20 days and if payment is not received within 20 days, the full amount of the late fee becomes due and owing.
