Untimely waiver request submitted by Jody P. Charbonnet, former member of the St. Tammany Parish Recreation / District #4, regarding a $1500 late fee assessed for filing his 2018 Tier 2.1 annual pfd 132 days late.
Facts:
Laurie Pennison is requesting a waiver on behalf of Mr. Jody Charbonnet for the late filing of his 2018 PFD for the following reasons:

Ms. Pennison stated that Mr. Charbonnet was appointed to the board mid-term so when he filed his 2017 financial statement in 2019, he labeled it as 2018 in error. She stated Mr. Charbonnet had no prior experience in the public sector and had never served on a Board of Commissioners before. He misunderstood his obligations regarding the filing of his annual disclosures. He was under the impression, through the board executive director, that the financial statement only needed to be filed with the Lacombe Recreation District Records, which he provided to the LR District for his/their records. Mr. Charbonnet was in the midst of building a house when COVID Pandemic started, and unfortunately he was distracted by the pandemic, loss of work, and construction to the home. He has since moved into said home which is out of the district, so he had to resign from his board. Ms. Pennison stated Mr. Charbonnet is not particularly comfortable with technology, preferring to fill out forms manually, but has been advised to complete his 2020 PFD.

Ms. Pennison stated that with the emergency declaration on Wednesday of this week, and loss of electricity to her home and office, they are asking that any delays in getting this waiver letter to the BOE be waived. Mr. Charbonnet still does not have electricity in Lacombe due to the hurricane. Mr. Charbonnet is very sorry that he failed to timely file his disclosure.

Law:
La. R.S. 42:1124.2.1 requires financial disclosure for each member and designee of a board or commission which has the authority to expend, disburse or invest $10,000 or more of funds in a fiscal year on or before May 15th of each year during which the person holds office and the year following termination of the holding of such office.

La. R.S. 42:1124.4 of the Code provides that upon discovery of the failure to file, failure to timely file, omission of information or inaccurate information, the Board shall notify the filer by sending him a notice of delinquency by certified mail. The notice of delinquency shall inform the person that the financial statement must be filed, or that the information must be disclosed or accurately disclosed, or that a written answer contesting the allegation of such failure, omission, or inaccuracy must be filed no later than seven (7) business days after receipt of the notice of delinquency.

Recommendations:
Consider the untimely waiver request. Suspend all based on future compliance with the Code of Ethics.
