Waiver request submitted by Arnel W. Cosey, Ph.D., New Orleans Workforce Development Board, regarding a $1500 late fee assessed for filing her amended 2018 Tier 2.1 annual PFD 109 days late.
Facts:
Arnel Cosey is requesting a waiver for the late filing of her 2018 Amendment for the following reasons:

Ms. Cosey states she was no longer serving on the New Orleans Library Board or the New Orleans Workforce Development Board in 2018, so she did not list them in the PFD. She officially divorced in 2014, therefore she did not report income for her former husband for the 2018 filing year. She filed the requested information upon receiving the request for the Delgado income and each time she was contacted by the BOE she immediately responded or rectified the situation. She stated she did not receive the Notice to Amend Delinquency dated 8/2/2019, nor did she sign for it on 8/5/2019; and the receiving signature is not hers or her mother's, who is the only other person living at the home during that time.

Ms. Cosey stated a monumental lesson was learned when she had to pay her first late fee assessment. She stated that fine has remained at the forefront of her mind since 2014; so she has consistently filed her disclosures timely and accurately according to the BOE Guidelines until the 2018 filing which only required clarification of her marital status and income. Ms. Cosey hopes the Ethics Board would approve her request to waive her late fee assessment.

Law:
La. R.S. 42:1124.2.1 requires financial disclosure for each member and designee of a board or commission which has the authority to expend, disburse or invest $10,000 or more of funds in a fiscal year on or before May 15th of each year during which the person holds office and the year following termination of the holding of such office.

La. R.S. 42:1124.4 of the Code provides that upon discovery of the failure to file, failure to timely file, omission of information or inaccurate information, the Board shall notify the filer by sending him a notice of delinquency by certified mail. The notice of delinquency shall inform the person that the financial statement must be filed, or that the information must be disclosed or accurately disclosed, or that a written answer contesting the allegation of such failure, omission, or inaccuracy must be filed no later than seven (7) business days after receipt of the notice of delinquency.
