Waiver request submitted by Harrison Carter Leak, IV, Louisiana Real Estate Appraisal Board, regarding an $800 late fee assessed for filing his 2018 Tier 2.1 annual PFD 16 days late.
Facts:
Harrison Carter Leak is requesting a waiver for the late filing of his 2018 PFD for the following reasons:

Mr. Leak stated he joined the Real Estate Appraisers Board in October 2018 in order to serve the State of Louisiana on behalf of the Louisiana Banking Industry. He is not paid for his service on the board, with the exception of being reimbursed for minor expenses. When going through board member orientation, he wasn't provided information regarding filing PFDs. When he consulted with the REA board about this, the board informed him that they communicated the annual BOE filing requirements during the first half of the year, but the board did not believe it was necessary since he just joined late in the year.

Mr. Leak stated if something was mailed, he did not receive it, as he has had significant trouble getting mail delivered to a rural area, in a new subdivision. Since he moved there in 2018, he is still the only home in the subdivision and that same year the developer changed the name of the street. When he received the Notice of Delinquency early 2020 (2/8/2020), he submitted the PFD as soon as possible. He stated he is not trying to hide any related interests or have any financial gains. He apologizes for the misunderstanding on his part, and requests the Ethics Board to have "mercy by waiving this late fee assessment". He thanks the Ethics Board for their consideration.

Law:
La. R.S. 42:1124.2.1 requires financial disclosure for each member and designee of a board or commission which has the authority to expend, disburse or invest $10,000 or more of funds in a fiscal year on or before May 15th of each year during which the person holds office and the year following termination of the holding of such office.

La. R.S. 42:1124.4 of the Code provides that upon discovery of the failure to file, failure to timely file, omission of information or inaccurate information, the Board shall notify the filer by sending him a notice of delinquency by certified mail. The notice of delinquency shall inform the person that the financial statement must be filed, or that the information must be disclosed or accurately disclosed, or that a written answer contesting the allegation of such failure, omission, or inaccuracy must be filed no later than seven (7) business days after receipt of the notice of delinquency.

Recommendations:
Suspend all based on future compliance with the Code of Ethics.
