Waiver request submitted by Donna Moore Wyatt, Benton Board of Alderman / District 4 / Bossier (Pop. 1948), regarding a $750 late fee assessed for filing her amended 2018 Tier 3 annual PFD 15 days late.
Facts:
Donna Wyatt is requesting a waiver for failing to file her 2018 Amendment timely for the following reasons:

Mrs. Wyatt stated she works for the USPS as a mail carrier. Since March 2020 due to the Covid-19 Pandemic, she has been working Monday - Friday ranging between 10-12 hours each day; and almost every Saturday to earn extra money to pay for their household and family bills. From the beginning of the Covid-19 Pandemic her mail load has increase significantly. Prior to the Coronavirus, her daily mail route load was about 80 packages; now its about 300 packages a day. Mrs. Wyatt stated her husband has worked for the Bossier Parish Sheriff's office for 17 years. She is a grandmother of three, and helps her two children to take care of the kids when they are at work and the children are not in daycare. She also provides care for her parents (mother 79 and father 82) by ensuring that they are feed and remain active. They purchased a foreclosure home from a bank that was in need of many repairs. In order to save money, she and her family have made the repairs themselves to save on the cost of labor. Mrs. Wyatt stated she does not recall what she did with the NOD that was issued in March 2020, she assumed the notice was misplaced until the day she found it and called in July 2020. She is asking the Ethics Board to please forgive her late fee as she has always had to work two or three jobs to provide for her family. She has never received government assistance or taken "handouts," but paying the fine would be a financial burden to her and her family.

Law:
La. R.S. 42:1124.3 requires persons holding a public office who represent a voting district having a population of less than 5,000 and each member of the governing authority or management board of a charter school created pursuant to Chapter 42 of Title 17 of the Louisiana Revised Statutes of 1950 to file a financial disclosure statement on or before May 15th of each year during which the person holds office and the year following termination of the holding of such office.

La. R.S. 42:1124.4 of the Code provides that upon discovery of the failure to file, failure to timely file, omission of information or inaccurate information, the Board shall notify the filer by sending him a notice of delinquency by certified mail. The notice of delinquency shall inform the person that the financial statement must be filed, or that the information must be disclosed or accurately disclosed, or that a written answer contesting the allegation of such failure, omission, or inaccuracy must be filed no later than seven (7) business days after receipt of the notice of delinquency.

Recommendations:
Suspend based on future compliance with the Code of Ethics.
