Untimely reconsideration request by Michael Pitman, candidate for District Judge, 1st Judicial District, Caddo Parish, in the November 4, 2014 election, relating to the reassessment of a previously suspended $280 fine for the late filing of his 30-P.
Facts:
Judge Pitman was assessed a late fee of $480 in connection with a late 30-P in 2014. At the February 20, 2015 meeting, $280 of this fine was suspended based on future compliance with the CFDA.

In connection with the November 3, 2020 election, Judge Pitman was assessed a late fee for a late 30-P. As a result, the $280 suspended late fee from 2014 was reinstated. Judge Pitman submitted the $280 under protest, and as a result, that payment was sent back. He insists the lack of ability to request reconsideration or waiver of the $280 is a lack of due process as well as disappointing in the midst of a pandemic. He further alleges that if the non-payment were sent to the AG's office, it would present a conflict of interest because he has received a form letter of congratulations from the AG on his successful election.

While the letters reference checks enclosed to pay the re-assessed amount, the fines appear to be currently unpaid.

Law:
18:1505.4.A(1) Any candidate, the treasurer or chairman of a political committee, or any other person required to file any reports under this Chapter, who knowingly fails to file or who knowingly fails to timely file any such reports as are required by this Chapter may be assessed a civil penalty for each day until such report is filed. 18:1484.(2)(b). Each candidate for any other public office shall file reports of contributions in excess of two hundred dollars in the aggregate during the aggregating period.

Rule 1207G: Within 20 days of receipt of the notice of the board's decision on the waiver request, the late filer may seek reconsideration of the board's decision only upon submission of information not provided or available to the board during its initial consideration of the matter.
