Advisory opinion request regarding whether the post-employment restrictions in the Code of Governmental Ethics (Code) would prohibit Dr. Tucker, a former Assistant Warden 4 at David Wade Correctional Center (DWCC), from entering into a contract with the Department of Corrections(DOC) after her retirement.
Facts:
Dr. Tucker retired on January 12, 2021 as an Assistant Warden 4 from DWCC, which is a part of DOC. She stated that as Assistant Warden 4 she provided clinical supervision of Dr. Flye, a DWCC employee who provides services to the Steve Hoyle Intensive Substance Abuse Program (SHISAP) at Bossier Correctional Center. She added that upon her retirement she anticipates a contractual arrangement with DOC Headquarters not DWCC. However, she stated that she would be supervising of Dr. Flye at SHISAP.
Law:
La. R.S. 42:1121B provides no former public employee shall, for a period of two years following the termination of his public employment, assist another person, for compensation, in a transaction, or in an appearance in connection with a transaction in which such former public employee participated at any time during his public employment and involving the governmental entity by which he was formerly employed, or for a period of two years following the termination of his public employment, render, any service which such former public employee had rendered to the agency during the term of his public employment on a contractual basis, regardless of the parties to the contract, to, for, or on behalf of the agency with which he was formerly employed.
Recommendations:
Adopt proposed advisory opinion.
