Waiver request submitted by Cynthia Alexander Green, former member of the Eastover Property Owners Association, regarding a $1500 late fee assessed for filing her 2017 Tier 2.1 annual PFD 131 days late.
Facts:
Cynthia Alexander Green is requesting a waiver for the late filing of her 2017 PFD for the following reasons:

Ms. Green stated she recalled submitting her PFD in May 2017, but when she looked at her records, she realized she faxed her 2016 PFD instead. She never thought she sent in the wrong document. Ms. Green stated there was "no malice" nor "ignoring the requirements" for her filing, she simply thought she submitted the correct documents.

She has since resigned from her term of 16 months on the board; and said she cannot afford a $1500 fine, as it was an honest mistake. Paying this fine will affect her ability to pay other monthly bills for some time. She is a senior citizen on a fixed income of Social Security, a $400 military check, and a couple of days a week of work to make ends meet. She asks the Ethics Board to please consider her income when making the waiver decision.

Law:
La. R.S. 42:1124.2.1 requires financial disclosure for each member and designee of a board or commission which has the authority to expend, disburse or invest $10,000 or more of funds in a fiscal year on or before May 15th of each year during which the person holds office and the year following termination of the holding of such office.

La. R.S. 42:1124.4 of the Code provides that upon discovery of the failure to file, failure to timely file, omission of information or inaccurate information, the Board shall notify the filer by sending him a notice of delinquency by certified mail. The notice of delinquency shall inform the person that the financial statement must be filed, or that the information must be disclosed or accurately disclosed, or that a written answer contesting the allegation of such failure, omission, or inaccuracy must be filed no later than seven (7) business days after receipt of the notice of delinquency.

Recommendations:
Suspend all based on future compliance with the Code of Ethics.
