Advisory Opinion the 23rd Judicial District Court contracting with a former court reporter, Gina Lee, following her employment with the 23rd JDC - Division D.
Facts:
Each judge in the 23d Judicial District Court has their own court staff, including secretary, court reporter, and bailiff. Gina Lee was employed exclusively as the court reporter for Division D in the 23rd JDC until December 31, 2020. Patricia Douglas, Judicial Administrator for the 23rd JDC, asks whether Ms. Lee can now contract with the 23rd JDC to provide services as a substitute or ad hoc court reporter for the other divisions in the 23rd JDC. Ms. Lee would receive a 1099 at the end of the year for her services.
Law:
La. R.S. 42:1121B(1) provides that no former public employee shall, for a period of two years following termination of his public employment, assist another person, for compensation, in a transaction, or in an appearance in connection with a transaction in which such former public employee participated at any time during his public employment and involving the governmental entity by which he was formerly employed, or for a period of two years following termination of his public employment, render, any service which such former public employee had rendered to the agency during the term of his public employment on a contractual basis, regardless of the parties to the contract, to for, or on behalf of the agency with which he was formerly employed.

AO 2020-619: Former Parenting Coordinator for 22nd JDC - Division K not prohibited from contracting with 22nd JDC to provide parenting coordinator services in other court divisions following the termination of her employment in Division K.

Recommendations:
Adopt the proposed advisory opinion.
