Waiver request submitted by John Douglas Wynn, Jr., Natchitoches Parish Communications District - 911, regarding a $350 late fee assessed for filing his amended 2018 Tier 2.1 annual pfd 7 days late.
Facts:
John D. Wynn, Jr. is requesting a waiver for the following reasons:

Mr. Wynn stated that he did not receive the NOD notifying him of the delinquency until after it was already past due. He stated the NOD was delivered next door, at his In-Laws house. He said normally any mail that is received at their home is given to him in a timely manner, but he did not receive this letter as he normally would. Mr. Wynn stated as soon as he was given the letter, he contacted the BOE and submitted the amendment. Mr. Wynn said the late filing was an oversight, as he does not receive any documentation from any entities or the State reminding him of the annual filing. However, he now knows to file his disclosure annually. He stated this will never happen again.



Mr. Wynn apologizes for the late filing and thanks the Ethics Board for their consideration on waiving his late fee assessment. This is Mr. Wynn's first late filing and late fee assessment.

Law:
La. R.S. 42:1124.2.1 requires financial disclosure for each member and designee of a board or commission which has the authority to expend, disburse or invest $10,000 or more of funds in a fiscal year on or before May 15th of each year during which the person holds office and the year following termination of the holding of such office.

La. R.S. 42:1124.4 of the Code provides that upon discovery of the failure to file, failure to timely file, omission of information or inaccurate information, the Board shall notify the filer by sending him a notice of delinquency by certified mail. The notice of delinquency shall inform the person that the financial statement must be filed, or that the information must be disclosed or accurately disclosed, or that a written answer contesting the allegation of such failure, omission, or inaccuracy must be filed no later than seven (7) business days after receipt of the notice of delinquency.

Recommendations:
Suspend all based on future compliance with the Code of Ethics.
