Facts:
Mr. Cravins is asking for consideration in regard to filing his 2021 registration late. He was undergoing cancer treatments. He provided documentation with respect to completion of diagnostic radiation treatment on February 2nd.

Law:
R.S. 24:53A provides that "[e]ach lobbyist shall register with the ethics board as soon as possible after employment as a lobbyist or after the first action requiring his registration as a lobbyist, whichever occurs first, and in any event not later than five days after employment as a lobbyist or not later than five days after the first action requiring his registration as a lobbyist, whichever occurs first."

Section 1205B of the Rules for the Board of Ethics provides that "[a]n automatic late fee shall not be assessed, and if one is assessed shall be rescinded by the staff, if the person required to file the report did not file the report for any of the following reasons which occurred on the due date or during the 14 days prior to the date the report was due: . . .2. serious medical condition, in the considered judgment of the staff, which prevented the person required to file or the person regularly responsible from filing the report timely . . ."


Recommendations:
Rescind the late fee pursuant to Rule 1205B(2).
