Waiver request submitted by Winifred Brooks, member of Workforce Development Board Area 21 known as Employ Baton Rouge, regarding two $700 late fees assessed for filing her amended 2017 and 2018 Tier 2.1 annual pfds 14 days late.
Facts:
Winifred Brooks is requesting a waiver for failing to amend her 2017 and 2018 PFDs for the followin greasons:

Ms. Brooks states that on 3/26/2018 she was promoted as the Baton Rouge Region Director within the Department of Children and Family Services, Economic Stability Division. Along with that promotion came the responsibility to serve as a department representative on LWDB. On 4/9/2018, the former DCFS Board Representative, Monica Brown, informed Ms. Brooks of her future duties as the new area director. When she received the LFO, she contacted the BOE to get a better understanding of what happened. She learned that several letters were sent to her PO Box and home address, but were all returned as unclaimed. She cannot explain how that happened as she has lived alone at that residence for over 20 years and has had the PO Box for over 40 years. She does not recall any of the delivery attempts. She has been employed with the DCFS for 31 years and understands the importance of completing tasks timely, as everything she does is also time sensitive and date driven. She stated having to pay $1400 in late fees, along with her medical bills, the IRS taxes she owes, her mortgage, her car payment, utility and other household and personal expenses would "be a definite hardship".

Law:
La. R.S. 42:1124.2.1 requires financial disclosure for each member and designee of a board or commission which has the authority to expend, disburse or invest $10,000 or more of funds in a fiscal year on or before May 15th of each year during which the person holds office and the year following termination of the holding of such office.

La. R.S. 42:1124.4 of the Code provides that upon discovery of the failure to file, failure to timely file, omission of information or inaccurate information, the Board shall notify the filer by sending him a notice of delinquency by certified mail. The notice of delinquency shall inform the person that the financial statement must be filed, or that the information must be disclosed or accurately disclosed, or that a written answer contesting the allegation of such failure, omission, or inaccuracy must be filed no later than seven (7) business days after receipt of the notice of delinquency.

Recommendations:
2017 - Suspend all based on future compliance with the Code of Ethics.
2018 - Suspend all based on future compliance with the Code of Ethics.
