RE:
Request that the Board waive the $500 campaign finance late fee assessed against Daniel L. "Danny" Dysart, a candidate for Judge, Court of Appeal, 4th Circuit, 3rd District, Division A in the November 3, 2020 election, whose 90-P campaign finance disclosure report was filed 5 days late.
Facts:


Daniel L. Dysart request a waiver and states the following:

As you know, his campaign account is managed by a committee in order to comply with Judicial ethics requirements. As such, the report, which was 5 days late, was provided by his committee Finance Chairman. Due to issues brought about by the Covid-19 pandemic, his office was working remotely and understaffed due to those issues. As a result, the report was inadvertently overlooked. His committee has not missed or been late for a report in the 10 years since he was elected Judge. Also, this term he was elected without opposition and did not have any fundraising activity. His campaign is still in debt from the 2010 election.

Law:
18:1505.4.A(1) Any candidate, the treasurer or chairman of a political committee, or any other person required to file any reports under this Chapter, who knowingly fails to file or who knowingly fails to timely file any such reports as are required by this Chapter may be assessed a civil penalty for each day until such report is filed.

18:1484.(2)(b). Each candidate for any other public office shall file reports of contributions in excess of two hundred dollars in the aggregate during the aggregating period.

Recommendations:
Suspend all but $300 based on future compliance.
